The short version. A local business uses our software to email you a birthday reward. We hold your name, email, birth date, and contact details on that business's behalf. We do not sell or share your information, we do not send text messages, and we do not use your information for our own marketing. Every message has a one-click unsubscribe and we honor it within two business days.
1. Who We Are
My Birthday Bonus, operated by Joy Station LLC, is a platform that local businesses (“Participating Businesses”) use to send birthday rewards to their own customers by email. When you receive one of these emails, it is sent on behalf of the business whose name appears in the message. We provide the technology.
We handle your information on that business's instructions. For most questions about how you came to be on the list, the business is the right place to start; we will help you reach it.
2. How You Come to Be Enrolled
You are enrolled in a Birthday Bonus program because you gave a Participating Business your details and permission to send you email — through that business's signup form on our platform, or through the business's own systems, which transmit the enrollment to us.
Our agreements with Participating Businesses require them to obtain permission before sending marketing email, to keep records of it, and to pass along opt-outs recorded in their other systems.
If we learn a member did not give permission, we suppress that member — they are removed from the sending pool and are not re-enrolled without documented consent.
3. Your Consent, and How to Withdraw It
What you receive. Recurring birthday-reward emails from the business — typically a small number per year.
How to stop. Every message includes a one-click unsubscribe honoring the RFC 8058 standard, plus a link in the body of the message. You may also write to us at the address in Section 16. We honor unsubscribes within two (2) business days.
Consent is never a condition of purchase.
Withdrawal is global for that program. An unsubscribe stops all Birthday Bonus messages from that business through our platform.
4. Text Messages
We do not send text messages. Nothing you accept on our platform is consent to receive SMS, and we make no claim of SMS consent on any business's behalf. If we ever introduce text messaging, we will obtain separate, affirmative, prior express written consent that is not bundled with any other agreement and not a condition of purchase, will disclose the program, the message frequency, and that message and data rates may apply, and will honor STOP and HELP.
5. Information We Collect
From the Participating Business or its signup form: your name, email address, date of birth, phone number (if provided), postal address fields, and a location reference identifying which of the business's locations you signed up at.
From your use of our messages: delivery, open, click, bounce, unsubscribe, and spam-complaint events.
We do not collect government identifiers, financial account numbers, or precise geolocation.
Date of birth is sensitive to identity fraud. We use it solely to schedule your reward.
6. How We Use It
To operate the program, deliver rewards, manage suppression and email deliverability, prevent fraud and abuse, comply with law, and produce aggregate non-identifying analytics. Nothing else.
7. We Do Not Sell or Share Your Personal Information
We do not sell personal information, and we do not share it for cross-context behavioral advertising, as those terms are defined under California law. We do not use it for our own marketing, and we do not disclose it to any other Participating Business.
8. Who We Disclose It To
- the Participating Business you enrolled with;
- service providers acting on our instructions under written contract — email delivery (Mailgun) and our hosting provider;
- as required by law or valid legal process; and
- to a successor in a merger or asset sale, subject to these commitments.
9. Your Choices and Requests
The most important control is the one in every message: unsubscribe. It stops the mail and we honor it within two business days.
You may also ask us what information we hold about you, ask us to correct it, or ask us to delete it. Write to us at the address in Section 16. We will verify that the request comes from you or someone authorized to act for you before we act on it.
How these requests are handled. Because we hold member information on behalf of the Participating Business, that business — not My Birthday Bonus — generally decides what happens to it. When you contact us we will acknowledge your request and forward it to the business, and we will tell you who that business is so you can contact it directly. We do not charge for this.
You will not be treated differently for making a request. Requesting deletion or unsubscribing has no effect on your ability to do business with any Participating Business.
California residents. We have not sold or shared personal information in the preceding twelve months. Your rights under California law — and comparable rights under other state privacy laws — may run against the Participating Business as the party that determines how your information is used; the route above is how to reach it.
10. Retention
We retain member records for as long as the Participating Business's program is active, and afterward as needed for legal, security, and record-keeping purposes, or until deletion is requested and approved by that business.
Suppression records — unsubscribes, spam complaints, bounces, and consent withdrawals — are retained indefinitely, because deleting them would risk contacting you again. This is deliberate, and it is how an unsubscribe stays honored.
11. Children
The Service is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. You must be 18 or older to enroll on your own. Members aged 13 to 17 may participate only with the consent and supervision of a parent or legal guardian who accepts the Terms of Service on their behalf. If we learn we hold information about a child under 13, we delete it. A parent or guardian may request deletion by writing to the address in Section 16.
12. Security
We use commercially reasonable safeguards, including access controls, encryption of data in transit, and least-privilege access to member data. No system is perfectly secure, and we do not warrant absolute security. If a breach affects your information, we will notify you and the relevant regulators as the law requires.
13. Geographic Scope
The Service is offered only in the United States and is not directed to individuals in the European Economic Area, the United Kingdom, or Switzerland. Do not enroll if you are outside the United States.
14. Changes
We review and update this Policy periodically. For material changes we will give at least 30 days' notice by email to your enrollment address and by posting the update here. Changes apply prospectively only.
15. Other Terms
Eligibility, acceptable use, rewards, disclaimers, limitation of liability, and dispute resolution (including arbitration, the class action waiver, and the 30-day opt-out) are set out in our Terms of Service, which this Policy is part of.
